What was the solution?
The solution was to reduce arrests, increase voluntary attendances and introduce Release Under Investigation (RUI). This provided a new framework however the clamour in the media for suspects to be on bail led to the government changing the law again.
As of the 28th October 2022 the law changed again allowing the police to put someone on bail for periods of up to 9 months for standard cases and even longer for nonstandard matters . This bail can include conditions that are quite restrictive. After this period the police can apply to the court for further time. Even if bail expires it does not mean the end of the matter as a person can remain under investigation for even longer.
If you are suspected of a criminal offence, you may be interviewed but not told of the outcome until some unspecified date in the future. You could be Released Under Investigation (RUI) This effectively means that there are no time limits for how long the case can take to investigate your case.
Suspects are left dangling. They are not updated, have no idea if and when a postal requisition will arrive and this leads to stress and anxiety.
